Texas Child Support Guidelines

To determine the obligation of the non-custodial parent for child support in Texas, the Court will want to know that person's net income.  This is usually determined by starting with the gross annual income and dividing that number by 12 to get the gross monthly income.  The Texas Family Code specifies the type and amount of taxes that should be deducted from this gross income amount to arrive at the monthly net income to use for the child support calculation.  Each year, the Texas Attorney General provides a new tax chart that simplifies the calculation of these authorized tax deductions.  See http://www.oag.state.tx.us/cs/taxcharts/2009taxchart.pdf.

Under the Texas child support guidelines, the percentage of net monthly income to be paid will vary according to the number of children to be supported. 

CALCULATE CHILD SUPPORT ON NET RESOURCES OF $7,500.00 OR LESS

The Texas child support laws are designed to apply to situations in which the obligor's monthly net resources are $7,500.00 or less.  Normally the child support is calculated according to the following percentages:

1 child 20% of the Obligor's net resources
2 children 25% of the Obligor's net resources
3 children 30% of the Obligor's net resources
4 children 35% of the Obligor's net resources
5 children 40% of the Obligor's net resources
6+ children Not less than the amount for 5 children

However, the percentage of net monthly income to be paid as child support will be reduced if the obligor has a duty to support children in more than one household:
