Children's Health Insurance

Medical Support for children in Texas

In addition to regular child support, there is a presumption that the noncustodial parent should provide health insurance or medical support for the child.

In Texas, "health insurance" means insurance coverage that provides basic health-care services, including usual physician services, office visits, hospitalization, and laboratory, X-ray, and emergency services.  Dental and vision insurance coverage is not usually required unless one of the parties has these available at a reasonable cost.

Although the non-custodial parent will be responsible for the health insurance premiums, both parents will share the cost of uninsured medical expenses incurred on behalf of a child including, the yearly deductible, any copayments for office visits or prescription drugs, and any other medical, surgical, prescription drug, mental health-care services, dental, eye care, ophthalmological, and orthodontic charges that aren't paid by insurance.

At The Guerra Law Firm, we will help ensure that your Court orders, including the provisions for medical support for your children, are carefully drafted to make them understandable for both parties and to ensure that they are legally enforceable.  We will also help you collect unpaid medical support and reimbursement of medical expenses that is due to you.  Call an experienced child custody and support attorney at The Guerra Law Firm to schedule an consultation today.
